For Publication: Answering The False Charges:
A portion of you folks will recognize from my name that I am very familiar with the Bundy case. I wish to address those posts (LVRJ and other blogs) that are accusing Mr. Bundy of allegedly being a squatter or stealing from the fine Citizens of Nevada by grazing his cattle on the public domain for free and for unlawful and personal monetary gain. Wrong!
Notice what Bundy's position is; the State of Nevada owns the lands pursuant to their NRS 321.596 et al statutes (Nevada Public Lands Ownership Act) enacted by Nevada back in the late 1970's. All the western public lands states adopted this law back when it was called the “Sagebrush Rebellion”. The main component of this law (Public Lands Ownership) has yet to be adjudicated by the courts or by the US Supreme Court. This matter came to the forefront once in the court process and the then Nevada Attorney General filed away this issue by stipulating that the feds owned the public lands in Nevada. The court basically said it had no other choice but to rule in favor of the Feds. (US vs Nye County). Bundy is following Nevada Law and holds that the 18 year old adverse decision against him that the BLM et al is using does not apply to him because he is not grazing on federal property. The State of Nevada has an obligation to enforce its own law on this matter. Therefore Bundy is not in contempt of any court order since he is not operating on federal property.
Bundy paid grazing fees to the rightful Landlord (Clark County-NV) back in the '90's and then they returned that payment to Bundy. I know this first hand because I was there when that happened. Bundy still has the county check and he never intended to steal anything and stands ready to pay the rightful Landlord today just like he did back in the '90's. Bundy is standing up for access and multiple uses of the public resources owned by the Citizens of Nevada. Bundy is not stealing, never did and never intended to, that is the factually correct record.
You folks that have leveled false accusations against Bundy may disagree with his legal position and that is ok to do so, but know that what is unfolding before your very eyes that you say should not be happening or even allowed is a very important lesson in civics. This is the way we do it in America. We should not be forced to drink the Kool-Aid and ordered to go take our seat and just shut up? Think about it.

important the cause for freedom in which they fight for. Remember the

principles that Cliven has been fighting for, for nearly 25 years now effect all

of us in a very real way. Clivens presence and private rights to our public

lands have kept it open and available for all of us to use and enjoy. I have no

doubt that if he is removed, it will make it easier for the BLM to reach their

goal of a closure of this land. This unconstitutional federal overrun is a

cancer that is destroying our free way of life, liberty and pursuit of

happiness and is spreading throughout our entire nation. It must be cut out and

stopped before it spreads beyond repair. The BLM has hired a contractor located

out of Nephi Utah and Logandale Nevada. They specialize in putting ranchers out

of business by collecting their cattle for the BLM. They plan on making this

move on Cliven on Wednesday the 11th of April. We need you to join and rally with

us to stop this movement. We the people can make a difference. I will inform

you of a specific place and time to rally when I know more. Spread the word.

Safety concerns for people involved with rounding up hundreds of renegade cattle belonging to Bunkerville rancher Cliven Bundy prompted the Bureau of Land Management to suspend indefinitely its plan to impound the herd, the local BLM manager said Wednesday.

"Our goal has always been to get these cattle off public lands in a safe way," said Mary Jo Rugwell, manager of the BLM's Southern Nevada District Office.

She said the BLM's Washington, D.C., office, headed by the bureau's former Nevada state director, Bob Abbey, made the decision to postpone this week's roundup to pursue legal proceedings in federal court.

"The bottom line was that because our goal was to do it safely, the BLM decision was made that we need to try the legal avenue again," Rugwell said, noting that "for many years there have been concerns how a gather operation would be received."

Rugwell said her staff has had discussions recently with Clark County Sheriff Doug Gillespie and Las Vegas police. "We asked for support in making sure everything was safe," she said.

Bundy, 65, said Wednesday that he doesn't perceive himself as a danger to the BLM because he has remained peaceful for 20 years during his feud over grazing cattle in the Gold Butte area.

"I sort of think they're overreacting in one sense, and in the other sense I don't know what indefinitely means," Bundy said by phone in response to Rugwell's comments about suspending the roundup.

"I'm damn tired of their harassment, their unconstitutional jurisdiction. I've fought this battle on paper, in the courts and in the media."

Bundy met with Gillespie twice in the days before he received a certified letter of the BLM's intent to follow through with impounding his herd this week. He said Gillespie called him Tuesday night to inform him that the BLM had decided to suspend the roundup.

"He told me to go ahead and do your ranching," Bundy said. "We're going to keep ranching, and we're going to keep this access open to the public."

When asked about the BLM's roundup Wednesday, Rugwell described it as "suspended indefinitely."

Said Bundy: "This shows how long their word is good."

Rugwell notified Bundy in an April 3 letter that his cattle would be rounded up and impounded because the herd has been roaming for 18 years "without authorization in areas that are closed to grazing" and in violation of a 1998 federal court injunction to stop grazing cattle on public lands.

The letter said Bundy would be contacted after all the cattle had been gathered and he would be allowed to claim any that bear his brand.

After learning that the BLM had forged a contract with Cattoor Livestock Roundup Inc. to gather and impound his cattle, Bundy notified the company and its operators Saturday that "there is a volatile situation currently taking place."

"While Cliven Bundy is not asserting any accusatory statement directly against the Cattoors or their companies as to their being hired to confiscate his property ... Cliven Bundy will do whatever it takes to protect his property and rights and liberty and freedoms and those of, We the People, of Clark County Nevada," his letter said.

The BLM canceled Bundy's grazing permit for the Bunkerville allotment in 1994, but he continued to graze hundreds of hybrid cattle adapted for harsh desert conditions on the much larger Gold Butte range, about 80 miles northeast of Las Vegas.

Bundy estimates he runs 500 adult cattle on 120 square miles, or 76,800 acres.

His permit for the Bunkerville allotment before it was canceled in 1994 allowed him to run about 150 cattle.

Rugwell said the Gold Butte area is roughly 500,000 acres. Her staff counted more than 500 cattle there in March 2011, about 730 in August, and 750 in early April.

The legal action the BLM is contemplating will cover all areas where Bundy's cattle roam, not just the previous Bunkerville allotment that was subject to the 1998 federal court injunction, Rugwell said.

She said the BLM is concerned about resource damage in the area.

"In my mind, the most important issue with respect with trespass is the fact trespass is unfair to other users, like recreationists. They pay fees and follow rules. In my mind it's a fairness issue," she said.

An environmental group, the Center for Biological Diversity, has been tracking the Gold Butte grazing issue and is considering a legal response to the BLM's indefinite halt to its roundup plans, or what the center's Las Vegas spokesman Rob Mrowka described as a "severe administrative setback."

By its lack of action, he said, the BLM continues to allow trespassing cattle to graze on habitat critical to the survival of federally protected desert tortoises and other species covered by Clark County's Multiple Species Habitat Conservation Plan.

In December 1998, Clark County bought grazing rights to the Bunkerville allotment for $375,000 and retired them for benefit and protection of the threatened desert tortoise.

"On the ground, even though good intentions have been made, nothing is different than before," Mrowka said.

Because the BLM continues to allow renegade cattle to graze in the Gold Butte area, Mrowka said the Center for Biological Diversity is considering sending the BLM a notice of intent to sue over the matter.

Rugwell said her staff had been preparing for the roundup for months.

"We would have liked to have been able to proceed, but we're going to move forward and do whatever we can to get those cattle removed in a safe way," she said.

Cliven Bundy is a hero of the range livestock operator on the public land. All of the grazing rights on the public land have been taken over by the federal government under grand theft from the states' rights and states' borders. So therefore, Bundy has never broken the law. Bundy's ancestors have been on the range in Nevada since 1877. His pioneer forefathers settled the ranching area where no one else would or could use it, developing the water and establishing a spread to raise desert cattle, a native breed that survives on browse. They developed the range and the water.

Cliven Bundy has followed in the same ranching business which established first use of the water, and the grazing and the browse which came with the water right. The ones that get first-use rights on the water get the first use of the grass and the browse. Grazing and the browse go together. This is a sacred God-given right of unalienable rights, private property rights. We believe in these things because without this our nation would have no foundation without God-given rights.

Cliven has been a strong and faithful friend to the grazing people and stood fast in every type of opposition that the BLM can throw at him and we admire his tenacity and determination to stay with his convictions. He has developed a special breed of cattle that can survive in the desert and still produce a calf. It's not a big money-making deal but it's a way of life for the Bundys to raise their family and to live peaceful and honest lives.

We have to admire people who will take what's left over in nature and make it produce food where nothing else can. Nature does a poor job of running a ranch or developing water or producing any food. Nature left by itself goes to rack and ruin. It takes man's hand and God's blessing to develop food on the desert or anyplace. We admire the Bundys for what they are doing. We give them our blessings and support to go ahead with what they are doing to defend their property rights, their cattle, their livestock, their livelihood and their way of life.

Every man who has a grazing permit on the forest service or BLM land should back Cliven Bundy with his support and prayers. Cliven Bundy is the last man standing in S.Nevada and needs our support and prayers to preserve his property and his way of life. The federal government claims to be able to charge grazing fees, a right they do not have under Article 1-8-17 of the U.S. Constitution.

BUNKERVILLE -- A long-simmering feud between rancher Cliven Bundy and federal land managers over grazing cattle on public land in the Gold Butte area may soon boil over as the Bureau of Land Management prepares to round up his 500-head herd.

Bundy contends that Clark County, not the BLM, is the proper landlord for the public lands. However, a roundup planned for today has been temporarily pushed back, the rancher said late Tuesday.

Bundy, 65, known as the last rancher running cattle year-round on a Southern Nevada range, received a letter Monday from BLM District Manager Mary Jo Rugwell that said he continues to be in violation of a 1998 federal court injunction to stop grazing cattle on public lands.

"The BLM issued you a notice of intent to impound on July 26, 2011 after your livestock were found grazing on public lands within the Gold Butte area without authorization in areas that are closed to grazing," Rugwell wrote in the letter dated April 3.

"Subsequent livestock checks have confirmed that your livestock remain on public lands and that you remain in violation of a permanent injunction."

Rugwell's letter said Bundy will be contacted after the cattle are removed, "and you will have an opportunity to claim any cattle that bear your brand."

A second letter he received this week from the local BLM district orders him to remove his water systems, fences, equipment and other range improvements from public land.

During a tour Tuesday of the Gold Butte area, Bundy said he intends to resist efforts by a government contractor to round up his cattle. His family and ancestors have grazed cattle and lived on the range about 80 miles northeast of Las Vegas since 1877.

Asked whether he would be armed while doing so, Bundy said, "I'm going to protect my livestock and the ranch. I hope it doesn't come to that point. I'm going to hold the state and ... the elected authorities responsible."

SHERIFF'S PEACEKEEPERS

Bundy said Sheriff Doug Gillespie met with him twice at his house in the past few days. Gillespie said his officers would be present as peacekeepers, Bundy recalled. Gillespie was the one who notified Bundy that the roundup had been delayed, the rancher said in a Tuesday night email.

"The emergency for tomorrow's range war seems to be declining," the email said. "I have been contacted by Clark County Sheriff Gillespie and the raid on my cattle has been temporarily suspended!"

Earlier, Bundy referenced the preamble of the U.S. Constitution and said he believes the sheriff "has an obligation to protect life, liberty and the property of 'We the people.' Federal rangers have no jurisdiction or authority, no policing power or arresting power."

"In talking to the sheriff, I said, 'If you have guts enough to say no (to the BLM), this issue would be over.' "

Dave Bundy, one of Bundy's sons, sent an email Tuesday to family friends before word of the roundup delay reached them. It said: "This unconstitutional federal overrun is a cancer that is destroying our free way of life, liberty and pursuit of happiness and is spreading throughout our entire nation."

Dave Bundy's email goes on to state that the BLM has hired a contractor that specializes "in putting ranchers out of business by collecting their cattle for the BLM. They plan on making this move on Cliven on Wednesday."

"We need you to join and rally with us to stop this movement. We the people can make a difference ... Saddle up and be ready," Dave Bundy wrote.

Cliven Bundy stopped paying grazing allotment fees to the BLM years ago and tried to pay them to Clark County after his federal grazing allotment was canceled in 1994 to protect habitat for the threatened desert tortoise and other sensitive species.

For 18 years he has bucked the BLM's authority and continued to graze cattle in the area. He estimates he runs 500 head of adult cattle on 120 square miles in the Gold Butte area that he calls his "ranch." The area includes 160 acres of private property near Bunkerville where his father built a house in 1951. Bundy and his wife, Carol, have raised 14 children there.

He said his problems with the BLM began in the early 1990s when the agency started "managing land to get ranchers and cattle off of it."

"No more moo in '92 and cattle-free in '93," he recalled ranchers saying of BLM policy.

Then, about one-fourth of grazing fees were supposed to be used by the BLM for range improvements and one-eighth for management. Bundy stopped paying his fees about that time. The BLM didn't cancel his Bunkerville allotment in 1994, Bundy contends -- he fired them.

"I'll be damned if I'm going to pay them to manage my ranch," he said Tuesday.

He said his firing of the BLM came about through letters he wrote to the solicitor of the United States and the BLM's national and state offices.

The BLM accused him of trespassing in a 1998 U.S. District Court case in Las Vegas. He lost and appealed to the 9th U.S. Circuit Court of Appeals in San Francisco, but the court upheld the injunction to remove his cattle from the public range.

Bundy asserts that the federal government has unlimited power over public land only if the land is a territory. He said the land where he grazes cattle was not owned by anybody but has been occupied by American Indian tribes and Mexico. It became U.S. territory through wars and remained as such until Nevada became a state.

'SOVEREIGN STATE'

"When Nevada became a state, it became a sovereign state with subdivisions in county governments," Bundy asserted. "We, the people, elect county sheriffs and pay the sheriffs with the county commissions to protect our life, liberty and property. The people of Clark County must own the public land in Clark County because the federal government, according to the Constitution, can't own property."

That's why Gillespie and his deputies are supposed to be peacemakers in his fight with the BLM, he said. Their job is to protect private property and "keep the federal government from stealing it."

Bundy said the ordeal has been "a strain on my family. We've been busy trying to defend ourselves."

Cliven Bundy a well respected man is being attacked by the federal government's agent through a contracted assailant company. He needs your help right now. For those of you who do not know Cliven and the current situation, let me introduce you. Cliven owns and operates a cattle ranch in Southern Nevada, Clark County. He by law, recognized by the State of Nevada, owns the grazing rights, water rights, range improvements, and rights to access the same upon the Bunkerville range. This ranch has been long established from the beginning of settling the west. Cliven for more than 50 years has been the steward of this range. The federal government/bureau of land management has not recognized these rights nor the States laws which protect them. They are in fact denying Cliven of his inalienable Constitutional rights to life, liberty, and property. They have hired a contractor to rustle cattle/property belonging to Cliven at an enormous price. If the federal government is allowed to proceed with this gather not only Cliven,s life will be ruined but yours will also be damaged. The loss of freedom happens slowly, so slowly that we often do not recognize the loss right away, not until we need to use that freedom that is no longer there but can't. In this case the federal government is not recognizing that the State of Nevada is even a state. It is being treated as though it were a territory, and it's people are not being afforded their Constitutional rights. Will you be next?

Dear Cattoor Family,

I come before you with great sorrow and concern.

Contract Cowboys is a dirty word in the western United States. They have done the bidding, plundering, and dirty work of the abusive bureaucrats, devastating the ranching industries and families. However, I have restrained my feelings and thoughts concerning your status, justifying your operation as doing more good than harm by gathering over populated horses and burros, and because of the good friend and neighbor Orville Cattoor is to me and my family. He has relayed to me the assurance that your business would never contract to gather domestic livestock. Dave Cattoor has personally stated he would not get involved in the seizure of my cattle.

I understand your family members and/or company are making plans to assist in the removal of my private property, mainly cattle branded VO and no brands. These cattle located on their natural habitat, ranging on my ranch, harvesting a renewable resource, one that can be harvested no other way, turning that resource or feed into an eatable and usable commodity for man. I and the preemptors of this ranch have established preemptive rights created from beneficial use of the water, forage, access, improvements and all other rights belonging to the, We the People, of Clark County Nevada. These rights, freedoms, and liberties; I will do whatever it takes to defend and/or uphold.

I will serve you and yours and company a constructive notice making you and anyone aiding or abetting with you accountable for all loss, damages, or expenses to my life, liberty, and property.

A constructive notice will be served to all county and state officers.

The local and national news media and magazines will be alerted of this man’s stand against an abusive bureaucratic agency without limitations. RANGE WAR!

While Cliven Bundy is not asserting any accusatory statement directly against the Cattoors or their companies as to their being hired to confiscate his property, (NOTE: the definition of property, includes and encompasses personal property, cattle and/or any domestic livestock, land and equipment) it is of the utmost importance that he advise that should you take part in any confiscation of the above property, Mr. Bundy and his heirs, et al. will institute an action against all parties, individually, who take or have taken an active role in said confiscation. There will be liens upon any and all property and accounts.

Once again, this is to be considered constructive notice that there currently is an action pending and that should you choose to take any adverse action against Cliven Bundy or his property, the appropriate legal remedies will be sought immediately. This will not necessarily preclude the filing of criminal complaints with the proper jurisdictional authority.

I have asked Clark County Sheriff Gillespie to say NO to this unconstitutional power without limitation seizure.

Action being taken from a 14 year old ruling from a U.S. District Court in Nevada. Therefore, I bring forth the same Constructive Notice and Demand for Protection before the official officers of the State of Nevada and Clark County, oath keepers which have taken a sworn oath to protect my life, liberty, and property.

This action of contract cowboys will bring forth emergency upon my life, liberty, and property destroying the production of a valid livestock business of converting renewable resources from the public land of the people of Clark County into an edible commodity.

Over the past 15 years the Bundy Ranch has improved and developed a supreme genetic breed of cattle adapted and established upon this desert ranch. Many water improvements and developments for wildlife and livestock, forage improvements and fuel load reduction for fire control, and the habitat for livestock and wildlife have been enhanced. The public; hunters, campers, sightseers, off roaders, and all multi-users have enjoyed access and the beauty of their public lands.

I will stand and protect my rights, whatever it takes, to defend this valid ranch, the access for the public, and the policing power of the Clark County Sheriff. This emergency is calling for your support and help.
